Move Your Butt (MYB) is owned and operated by Bowel Cancer New Zealand (BCNZ), a registered charity under the Charities Act 2005 (registration CC44166). The purpose of MYB is to raise funds to support people affected by bowel cancer in New Zealand.

By registering for or participating in MYB2026, you agree to these Terms and Conditions.

1. Registration

1.1 Registration for MYB is free.

1.2 Participants must provide accurate personal information. We use this information to communicate with you about MYB, track your fundraising, deliver rewards and prizes, and for any other purposes you have consented to.

1.3 Participants under 16 years of age must obtain parental or guardian consent before registering. By registering a child under 16, the parent or guardian agrees to these Terms and Conditions on the child's behalf and consents to the child receiving MYB-related communications from BCNZ.

1.4 By registering for MYB, you consent to receiving communications from BCNZ about MYB2026, future MYB campaigns and general BCNZ updates. You can unsubscribe from marketing communications at any time.

 

2. Participation

2.1 MYB officially runs from 1 February to 28 February 2026. However, participants may register and start fundraising before these dates and continue fundraising afterwards. Fundraising pages will remain open for at least 30 days after 28 February 2026.

2.2 Participants are encouraged to complete 100km during February, but may set their own goals and complete the challenge at their own pace using any method (walking, running, cycling, or other physical activity).

2.3 Logging of kilometres is voluntary. Participants may use any fitness app that integrates with our fundraising platform, or log kilometres manually.

2.4 Participation is at your own risk. You are responsible for ensuring any physical activity is appropriate for your health and fitness level. BCNZ recommends consulting a healthcare professional before starting any new exercise programme.

2.5 BCNZ is not responsible for any injury, illness, loss, or damage arising from your participation in MYB or any related activities.

 

3. Fundraising and Donations

3.1 Fundraising is conducted primarily through the BCNZ online fundraising platform, which is operated by a third-party provider. By using the platform, you also agree to the platform provider's terms and conditions and privacy policy.

3.2 Offline fundraising is permitted. All funds raised offline must be deposited either through your online fundraising page or directly into BCNZ's bank account. Contact us at [email protected] for bank account details.

3.3 There is no minimum fundraising requirement to participate in MYB.

3.4 All fundraising activities must comply with New Zealand law, including the Charities Act 2005 and any applicable regulations regarding raffles, auctions, and collections. BCNZ can provide guidance on request.

3.5 Donations made online through your fundraising page will automatically receive a tax receipt. BCNZ may not be able to issue receipts for donations received through offline fundraising where donor details are incomplete.

3.6 All donations to BCNZ are non-refundable unless required by law.

 

 

4. Rewards and Badges

4.1 Participants who raise $150 or more are eligible to receive a MYB t-shirt.

4.2 To claim your t-shirt, you must complete the claim form that will be emailed to you once you reach the $150 threshold. T-shirts are subject to availability. If your requested size is not available, we may send you then next available size up.

4.3 The fundraising platform includes gamification features such as badges, milestones, and achievements. These features are provided for motivation and engagement purposes only.

4.4 While we endeavour to ensure badges and achievements are awarded accurately, we do not guarantee that:

Badges will be awarded immediately or at all

Badge criteria will remain unchanged throughout the campaign

All badges or achievements will be available for the duration of the campaign

Badges will display correctly on all devices or browsers

4.5 Badges and achievements have no monetary value and do not entitle you to any prize, reward, or other benefit unless expressly stated.

4.6 BCNZ reserves the right to modify, add, remove, or discontinue any rewards, badges, or gamification features at any time without notice.

 

5. Prize Draws and Giveaways

5.1 BCNZ may run prize draws and spot prize giveaways during MYB 2026. Specific terms for each prize draw or giveaway will be communicated at the time of the promotion.

5.2 Unless otherwise stated, the following general terms apply to all prize draws and giveaways:

Eligibility

• • Prize draws are open to registered MYB 2026 participants who are New Zealand residents, unless otherwise specified.
  • Employees of BCNZ, their immediate family members, and anyone directly involved in organising the prize draw are not eligible to win.
  • No purchase or donation is necessary to enter a prize draw, unless otherwise stated.
  • Making a donation does not increase your chances of winning.

Entry

• • Entry is by registration for MYB 2026, or by such other method as specified for individual promotions (for example, early bird registration by a specified date).
  • Only one entry per person per prize draw, unless otherwise stated.
  • Entries must be received by the closing date and time specified for each promotion.

Winner Selection and Notification

• • Winners will be selected by random draw from eligible entries.
  • Winners will be notified by email or phone using the contact details provided at registration.
  • If a winner cannot be contacted within 7 days of the draw, or is unable or unwilling to accept the prize, BCNZ reserves the right to select an alternative winner.
  • Winners may be announced on BCNZ's website and social media channels. By entering, you consent to your name being published if you win.

Prizes

• • Prizes are as described at the time of the promotion and are subject to availability.
  • Prizes are not transferable and cannot be exchanged for cash or other alternatives, unless otherwise stated or required by law.
  • BCNZ reserves the right to substitute a prize of equivalent value if the advertised prize becomes unavailable.

General

• • BCNZ's decision on all matters relating to prize draws is final, and no correspondence will be entered into.
  • BCNZ reserves the right to disqualify any entry that it reasonably believes breaches these terms, is fraudulent, or is otherwise inappropriate.
  • BCNZ reserves the right to cancel, modify, or suspend any prize draw if circumstances beyond its control make this necessary.
  • Prize draws are governed by New Zealand law.

 

6. Facebook Group

6.1 BCNZ operates a private Facebook group for MYB participants to connect, share tips, and celebrate milestones.

6.2 By joining the group, you agree to:

• • Be respectful and supportive of other members
  • Follow BCNZ's community guidelines and any rules posted in the group
  • Refrain from posting spam, promotional content, or material that is offensive, defamatory, or otherwise inappropriate

6.3 BCNZ may remove any posts or members that do not comply with these rules, at its sole discretion.

 

7. Costs and Expenses

7.1 Participants are responsible for any costs associated with their participation, including costs of physical activity (such as gym memberships or equipment) and any offline fundraising activities.

7.2 Fundraising expenses should be reasonable and proportionate to the funds raised, to maximise the benefit to people affected by bowel cancer.

 

8. Responsible Fundraising

8.1 Fundraisers must act ethically and in accordance with BCNZ's values.

8.2 The following fundraising methods are not permitted:

• • Door-to-door solicitation
  • Telephone solicitation (cold calling)
  • Street fundraising or collecting in public places without appropriate permissions
  • Any aggressive, misleading, or inappropriate tactics

8.3 All promotional materials and activities must clearly acknowledge that you are "Proudly supporting Bowel Cancer New Zealand" and must not imply that your fundraising is an official BCNZ event or that you are acting as an agent of BCNZ.

8.4 Use of BCNZ's name, logo, or branded materials requires prior written approval. Please contact us at [email protected] for approval.

8.5 You must not offer or provide any gift, payment, or other benefit to any person as an inducement to make a donation, where this could be perceived as a bribe or improper payment.

 

9. Platform and Technology

9.1 MYB uses a third-party fundraising platform and may integrate with third-party fitness tracking applications (such as Strava). These services are provided by independent companies and are subject to their own terms of service and privacy policies.

9.2 While we endeavour to ensure the platform and integrations work smoothly, we do not guarantee that:

• • The platform will be available at all times or operate without interruption
  • Integrations with fitness apps (such as Strava) will sync correctly or at all
  • Kilometres logged will always be recorded accurately
  • Leaderboards and fundraising totals will update in real time
  • All features will work on all devices, browsers, or operating systems
  • Data will not be lost due to technical issues

9.3 BCNZ is not responsible for:

• • Technical issues, outages, or errors with the fundraising platform or any third-party services
  • Loss of data, including logged kilometres, fundraising progress, or account information
  • Failure of fitness app integrations to connect or sync
  • Delays in processing donations or updating fundraising totals
  • Any issues arising from your internet connection, device, or software

9.4 If you experience technical issues, please contact us at [email protected] and we will do our best to assist. However, we cannot guarantee resolution of all technical issues, particularly those relating to third-party services.

9.5 You are responsible for maintaining your own records of kilometres completed and donations received if accurate records are important to you.

 

10. Privacy

10.1 By registering for MYB, you agree to the collection, use, and disclosure of your personal information in accordance with the MYB Privacy Statement and the BCNZ Privacy Policy.

10.2 Your personal information will be shared with our fundraising platform provider as necessary to operate the campaign.

10.3 Certain information (including your name, fundraising page content, and fundraising progress) may be publicly visible on the campaign website and leaderboards.

 

11. Media and Content

11.1 Any photos, videos, stories, or other content you share with BCNZ through the fundraising platform, social media, email, or other channels may be used by BCNZ for promotional, marketing, and educational purposes, for MYB2026 or future events.

11.2 By sharing content with BCNZ, you grant BCNZ a non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, and publish that content in connection with MYB and BCNZ's charitable activities.

11.3 You confirm that any content you share is your own original work or that you have the necessary rights and permissions to share it, and that it does not infringe any third party's rights.

11.4 If you do not wish your content to be used, please contact us before sharing it, or let us know and we will remove it where reasonably practicable.

 

12. Limitation of Liability

12.1 To the maximum extent permitted by law, BCNZ, its employees, contractors, volunteers, and representatives are not liable for any:

• • Personal injury, illness, or death arising from participation in MYB or related activities
  • Loss of or damage to property
  • Loss of data, including logged kilometres, fundraising progress, or other information
  • Technical failures, platform outages, or integration issues
  • Economic loss, loss of profits, or consequential loss
  • Any other loss or damage of any kind
  • arising from or in connection with MYB, the fundraising platform, or any third-party services, except to the extent caused by BCNZ's negligence or wilful misconduct.

12.2 Nothing in these Terms and Conditions excludes or limits any rights you may have under the Consumer Guarantees Act 1993 or any other rights that cannot be excluded by law.

 

13. Indemnity

13.1 You agree to indemnify and hold harmless BCNZ, its employees, contractors, volunteers, and representatives from and against any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

• • Your participation in MYB or related fundraising activities
  • Your breach of these Terms and Conditions
  • Your negligence or wilful misconduct
  • Any content you share that infringes a third party's rights

 

14. General

14.1 These Terms and Conditions are governed by New Zealand law. Any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.

14.2 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 BCNZ's failure to enforce any right or provision of these Terms and Conditions does not constitute a waiver of that right or provision.

14.4 BCNZ reserves the right to update these Terms and Conditions at any time. Changes will be posted on the MYB website. Continued participation after changes are posted constitutes acceptance of the updated terms.

14.5 BCNZ reserves the right to revoke participation privileges or fundraising authority if these Terms and Conditions are breached.

VIP Early Registration Promotion and Prize Draw

These terms apply to the Move Your Butt (MYB) 2026 VIP Registration Promotion (“Promotion”). By entering the Promotion, you agree to these terms along with the general Move Your Butt 2026 Terms and Conditions.
 
1. Promotion Period
1.1 The Promotion runs from 12:01am Wednesday 3 December 2025 until 11:59pm Friday 12 December 2025 (NZDT).
1.2 Registrations received outside this period are not eligible for entry.
 
2. Eligibility
2.1 Entry is open to individuals who:

• Have previously participated in Move Your Butt in any previous year; and
• Register for MYB 2026 during the Promotion Period.

2.2 Participants may reside anywhere in the world; however:

• Only participants with a valid New Zealand postal address are eligible to win the prize.

2.3 Employees, contractors, and board members of Bowel Cancer New Zealand (BCNZ), and their immediate family members, are not eligible to win.
2.4 Participants under 16 must have parental or guardian consent to register.
 
3. How to Enter
3.1 Eligible participants receive one (1) automatic entry when they register for MYB 2026 during the Promotion Period.
3.2 Only one entry per person is permitted.
3.3 BCNZ is not responsible for late, incomplete, or inaccurate entries, including those caused by technical or platform issues.
 
4. Prize
4.1 There is one (1) prize: Apple Watch SE 3 40mm Midnight Aluminium Case GPS Sport Band (S/M) [2025]
4.2 The prize is not transferable, exchangeable, or redeemable for cash.
4.3 If the prize becomes unavailable for any reason, BCNZ may substitute it with a prize of equal or greater value.

5. Winner Selection and Notification
5.1 One winner will be drawn at random from all eligible entries.
5.2 The draw will take place within 7 days of the Promotion closing.
5.3 The winner will be notified via the email or phone number provided at registration.
5.4 If the winner cannot be contacted within 7 days, or is not eligible to receive the prize, BCNZ may conduct a redraw.
5.5 The winner’s name may be published on BCNZ’s website and social media channels. By entering, you consent to this disclosure.
 
6. Limitation of Liability
6.1 To the maximum extent permitted by law, BCNZ is not liable for any loss, damage, injury, or other consequences arising from or in connection with the prize, including after it has been received by the winner.
6.2 BCNZ does not accept responsibility for any defects, faults, or issues with the prize once it has been delivered to the winner.
 
7. General
7.1 Entry into the Promotion is subject to the Move Your Butt 2026 Terms and Conditions, which apply in addition to these Promotion Terms.
7.2 BCNZ may disqualify any entry that breaches these terms, is incomplete, fraudulent, or otherwise inappropriate.
7.3 BCNZ may modify, suspend, or cancel the Promotion if circumstances beyond its control make this necessary.
7.4 The Promotion is governed by New Zealand law.
 
8. Privacy

8.1 By entering the Promotion, you agree that BCNZ may use your personal information to administer the prize draw.
8.2 Personal information will be handled in accordance with the BCNZ Privacy Policy.
8.3 Only the winner’s name (first name and initial) may be publicly disclosed.
